Terms and Conditions - Landscapers Manorpark
These Terms and Conditions set out the basis on which landscaping services are provided in Manorpark and the surrounding area. They are designed to make the relationship between the service provider and the customer clear, fair, and professionally managed from the first enquiry through to project completion. By requesting a quotation, confirming a booking, or allowing work to begin, the customer agrees to these terms.
For the purpose of this document, the words we, us, and our refer to the landscaping service provider, while you and your refer to the customer. These terms apply to all services, including garden maintenance, turfing, planting, fencing, paving, hedge trimming, patio installation, and other landscaping work carried out in Manorpark.
1. Scope of Services
Our landscaping services are provided according to the written quotation, agreed specification, or confirmed work schedule. The exact scope of work may vary depending on the size of the garden, the condition of the site, access restrictions, and the materials selected. Any items not specifically listed in the quotation are excluded unless agreed in writing before the work begins.
We aim to deliver high-quality results that reflect the agreed brief. However, landscaping work often involves natural materials and site-specific conditions. As a result, minor variations in appearance, colour, texture, and finish may occur. These differences are normal and do not automatically mean the work is defective.
2. Quotations and Estimates
All quotations are based on the information available at the time they are prepared. This may include measurements, site photographs, customer descriptions, and any inspection carried out in person. Quotations are generally valid for a limited period and may be revised if project conditions change or if materials, labour costs, or access arrangements are altered.
An estimate is not the same as a fixed quotation. An estimate is a best professional assessment of likely costs and may change once the full scope of work is confirmed. If a quotation is marked as fixed, it applies only to the agreed specification and does not cover extra work requested later.
We reserve the right to adjust prices if unforeseen issues arise, including but not limited to hidden obstacles, poor ground conditions, waste disposal changes, or customer-requested modifications. Where practical, any additional cost will be discussed before further work is undertaken.
3. Booking and Acceptance
A booking is considered accepted when the customer confirms the work in writing, verbally agrees to the proposal, pays any required deposit, or allows the service to commence. Once accepted, the customer agrees to these terms and any supplementary conditions set out in the quotation or invoice.
We may request confirmation of access details, preferred timings, and any special instructions before scheduling work. It is the customer’s responsibility to ensure the property can be accessed safely on the agreed date. If access is restricted or delayed, the project may need to be rescheduled and extra costs may apply.
Booking Changes
If you need to change a booking date or alter the agreed work, please notify us as soon as possible. We will make reasonable efforts to accommodate changes, but availability cannot always be guaranteed. Significant amendments may require a revised quotation or new completion date.
4. Customer Responsibilities
To help the project proceed smoothly, the customer must ensure the work area is reasonably clear and accessible. This includes removing personal items, securing pets, and informing us of any underground services, hidden hazards, or fragile features that may affect the work. Where required, the customer should obtain permission from landlords, managing agents, or neighbours before work starts.
You are responsible for confirming that the proposed landscaping work is permitted under local rules, lease conditions, covenants, or planning restrictions where applicable. Although we may offer practical advice, compliance remains the customer’s responsibility unless otherwise agreed in writing.
Important: If existing surfaces, structures, or plants are to remain in place, the customer must identify them clearly before work begins. We cannot be held responsible for damage to items that were not reasonably identifiable or that were not disclosed in advance.
5. Materials and Product Quality
Materials used in landscaping projects may include natural stone, timber, topsoil, gravel, turf, plants, compost, sand, and manufactured products. Where the customer selects materials, it is their responsibility to ensure those materials meet their expectations before installation. Natural products may include visible differences in colour, size, grain, or pattern. These variations are part of the product’s natural character and are not normally considered defects.
We aim to source materials from reliable suppliers, but we cannot guarantee that every batch will be identical. If a specific brand, grade, or finish is required, it should be stated clearly in the quotation. Any substitutions made for availability reasons will be of comparable quality where possible.
Plants and turf are living materials. Their performance depends on weather, soil quality, watering, seasonal conditions, and aftercare. We do not guarantee long-term growth or survival unless a specific written guarantee has been provided.
6. Payment Terms
Payment terms will be outlined in the quotation or invoice. Unless stated otherwise, payment is due upon completion of the work or within the specified time period. For larger projects, staged payments or a deposit may be required before materials are ordered or labour is scheduled.
Failure to make payment on time may result in suspension of work, delayed handover, or additional administrative charges where permitted. If any invoice remains unpaid, we may pursue recovery of the amount owed through lawful means. Any discounts, promotions, or agreed price reductions apply only if the customer complies with the stated payment terms.
We reserve the right to charge for additional work requested after the original agreement, including changes in design, extra labour, waste removal, or upgraded materials.
7. Cancellations and Rescheduling
If the customer wishes to cancel a booking, notice should be given as early as possible. Depending on the stage of the project, cancellation charges may apply, especially where materials have been ordered, labour has been allocated, or preparatory work has already been completed.
We may also need to reschedule work because of severe weather, safety concerns, supplier delays, or other circumstances outside our control. In such cases, we will aim to provide a new suitable date. We are not liable for indirect loss caused by delay where the delay is beyond our reasonable control.
Deposits and Cancellations
Where a deposit has been paid, it may be non-refundable if materials have been purchased or if the booking prevented us from accepting other work. The exact treatment of deposits will depend on the quotation and the status of the project at the time of cancellation.
8. Project Timelines
Any timeline provided is an estimate unless expressly stated otherwise. Landscaping work may be affected by weather, ground conditions, supply issues, access limitations, and project changes. While we work efficiently to complete projects within the expected time frame, delays can occur.
Completion dates are therefore not guaranteed unless specifically agreed in writing. We will keep the customer informed of any significant changes and aim to minimise disruption wherever possible. Timely decisions from the customer, especially on material choices and design approvals, help prevent avoidable delay.
9. Variations and Additional Work
Any request to change the original specification may be treated as a variation. This could include alterations to design, materials, layout, planting plan, drainage, or finish. Variations may affect cost and completion time. We will normally confirm any increase or reduction in price before the changed work begins.
If hidden issues are found during the course of work, such as old foundations, unsuitable soil, drainage problems, or previously buried debris, we may need to pause the project while options are discussed. Additional work required to deal with such issues will be charged separately unless the quotation clearly included those risks.
10. Waste Removal and Site Clearance
Where agreed, we will remove waste generated by the landscaping work in accordance with relevant disposal requirements. The quotation will normally state whether waste removal is included. If it is not included, the customer is responsible for arranging disposal.
Although we make reasonable efforts to leave the site tidy, some light debris or dust may remain after work, especially where cutting, digging, or hard landscaping has been carried out. Final cleaning beyond standard site clearance may need to be requested as an additional service.
11. Plants, Turf, and Aftercare
Plants and turf require proper watering, feeding, mowing, and maintenance after installation. Because these materials are living and affected by conditions outside our control, the customer must follow any aftercare advice provided. Failure to maintain newly installed planting or turf can reduce performance or cause loss.
We may provide general advice on care, but this does not replace the need for ongoing maintenance. If maintenance is not included in the service agreement, responsibility for aftercare passes to the customer upon completion of the work.
Seasonal factors such as frost, heat, heavy rain, drought, or wind may influence results. These are natural risks associated with outdoor landscaping and do not automatically indicate poor workmanship.
12. Guarantees and Limitations
Any guarantee will only apply if it is expressly stated in writing. Unless a written guarantee exists, all work is provided on the basis of reasonable skill and care. Expected outcomes may be affected by site conditions, weather, material characteristics, and customer maintenance.
We do not guarantee the success of planting schemes, lawn establishment, or the long-term performance of materials exposed to normal wear, extreme weather, movement in the ground, or lack of maintenance. Structural elements such as paving, decking, or fencing may also change over time due to natural settlement or environmental conditions.
13. Liability
We will take reasonable care while carrying out landscaping work. However, our liability is limited to direct loss or damage caused by our proven negligence or breach of contract. We are not liable for indirect, incidental, or consequential losses such as loss of use, inconvenience, or business interruption.
We are not responsible for damage caused by pre-existing faults, hidden defects, third-party actions, adverse weather, poor prior workmanship, or circumstances beyond our control. If damage occurs due to our work, please notify us promptly so the matter can be assessed.
Where permitted by law, our total liability will not exceed the amount paid for the specific service giving rise to the claim, except in cases where the law does not allow such limitation.
14. Property Access and Safety
Safe access to the property is essential. The customer must inform us of restricted entrances, narrow paths, low walls, overhead wires, uneven surfaces, or any other condition that may affect safe delivery of materials or equipment. If access is unsafe or not adequately disclosed, we may postpone the work or adapt the method of delivery and installation.
We operate with consideration for health and safety. However, the customer should also ensure that residents, visitors, children, and pets remain clear of active work areas. We may stop work if conditions become unsafe.
15. Ownership of Materials
Any materials supplied by us remain our property until payment has been received in full, unless otherwise agreed in writing. If payment is not made, we may be entitled to remove or recover supplied goods where lawful and practical.
Once installed and paid for, ownership of the completed work transfers to the customer, subject to any retained rights stated in the contract. Materials supplied by the customer remain their responsibility unless we have expressly agreed to store or handle them.
16. Complaints and Corrections
If you are unhappy with any aspect of the service, please raise the issue as soon as reasonably possible so it can be reviewed. We value fairness and aim to resolve complaints in a professional and practical manner. Depending on the matter, this may involve an inspection, clarification of the original specification, or corrective work.
Reasonable opportunities to inspect and, where appropriate, correct a genuine issue will normally be provided before any third-party intervention is arranged. This allows both sides to resolve matters efficiently and avoids unnecessary escalation.
17. Events Beyond Our Control
We are not responsible for delays or failure to perform where the cause is outside our reasonable control. This may include extreme weather, flooding, fire, industrial action, supplier failure, transport disruption, accidents, public restrictions, or sudden illness. In such cases, obligations may be suspended until the issue is resolved or a practical alternative is agreed.
18. Data Use and Privacy
Any personal information shared in connection with the landscaping service is used only for project administration, communication, invoicing, and lawful record-keeping. We handle customer information responsibly and do not use it for unrelated purposes unless required by law or agreed in writing. This section should be read together with any applicable privacy notice or data policy where provided.
19. Changes to These Terms
These Terms and Conditions may be updated from time to time to reflect legal, operational, or service-related changes. The version in force at the time of booking will normally apply to that project unless a later version is agreed by both parties.
20. Governing Law
These terms are governed by the laws applicable in the relevant jurisdiction for work carried out in Manorpark. Any dispute relating to the service will be handled under the appropriate legal framework. If any part of these terms is found to be unenforceable, the remaining provisions will continue to apply.
Final Statement
By proceeding with a landscaping service in Manorpark, the customer confirms understanding of these Terms and Conditions and agrees to cooperate with the requirements that support a safe, efficient, and professional project. Clear communication, accurate specifications, and timely payments help ensure the best possible outcome for every landscaping job. These terms are intended to protect both parties and create a transparent working relationship based on trust, quality, and practical expectations.
